　一、基本案情 北京君策九州科技有限公司（即本案被申请人）以无正当理由连续三年不使用为由，于2015年12月15日对福莱服饰有限公司（即本案申请人）注册的第8815851号“discoveruw men’s underwear及图”商标（以下称复审商标）向商标局提出撤销申请，请求撤销复审商标在第25类“内衣、防汗内衣、内裤、鞋、帽、袜”等全部核定商品上的注册。商标局经审查认为申请人提供的商标使用证据无效，复审商标予以撤销。申请人不服，依法向商标评审委员会提出复审。 　二、决定结果 商标评审委员会经审理认为，复审商标被许可使用人温州探索进出口有限公司于2012年12月15日-2015年12月14日期间内对复审商标于中国在“男士内裤”商品上已实际投入生产经营，虽然该行为系贴牌加工，商品未在中国大陆市场流通，但是，该实际生产经营行为仍发生在中国大陆地区，这种行为实质上是在积极使用商标，符合修改前《商标法》第四十四条第（四）项注册商标连续三年停止使用撤销规定旨在鼓励和促使商标权人使用商标，避免商标资源闲置、浪费，保障商标制度良好运转的立法目的。故对复审商标在与“男士内裤”相同或类似的“内衣、防汗内衣、内裤”商品上的注册予以维持，在其余商品上的注册予以撤销。 　　三、典型意义        本案的焦点问题是贴牌加工的生产行为是否属于商标法所称商标的“使用”。商标评审委员会认为，注册商标连续三年停止使用撤销制度的立法目的旨在鼓励和促使商标权人使用商标，避免商标资源闲置、浪费，保障商标制度良好运转。就贴牌加工问题而言，虽然贴牌加工的商品并未在中国大陆市场流通，但是商品的生产加工行为发生在中国大陆，生产者将商标附着于商品的行为具有使之区分商品来源的真实意图。这种行为本身是对商标进行积极使用的体现，对这种行为持鼓励态度符合上述立法目的。反之，若不认定此类使用行为的效力而撤销商标注册，则易使生产者的正常经营活动因对外贸易、海关政策而受阻，不利于社会生产秩序的稳定，也不利于商标注册制度的有序运转。故本案中，商标评审委员会认为申请人提交的使用证据有效，复审商标在相应商品及类似商品上予以维持注册。         复审商标：
